Terms of Service

1. Acceptance of Terms

By creating an account or using Runup ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Service Description

Runup is a web-based aircraft records management platform for general aviation owners. The Service allows you to digitize aircraft maintenance logbooks using AI-powered OCR, organize maintenance records, track airworthiness directive compliance, and share records with buyers and mechanics through secure portals.

Runup is a digital companion to your physical records. The Service does not replace official FAA-required paper logbooks. You are responsible for maintaining your original records in accordance with applicable regulations.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@runuppro.com if you suspect unauthorized access.

You must be at least 18 years old to use the Service.

4. Subscriptions and Billing

Runup offers a free tier with limited features and paid subscription plans ("Pro"). Paid plans are billed monthly on a per-aircraft basis. Payments are processed securely through Lemon Squeezy, our third-party payment processor.

By subscribing to a paid plan, you authorize recurring monthly charges at the rate displayed at checkout. Prices are listed on our Pricing page. We may update pricing with at least 30 days notice before your next billing cycle.

Adding or removing aircraft from your subscription adjusts your quantity and billing amount. Quantity increases may take effect immediately. Quantity decreases take effect at the start of your next billing cycle.

5. Refunds and Cancellations

You may cancel your subscription at any time from your account settings or through the Lemon Squeezy customer portal. When you cancel:

• Your subscription remains active until the end of your current billing period.
• You retain full access to paid features through that date.
• After the billing period ends, your account reverts to the free tier. Your existing data remains accessible, but you will not be able to add new content beyond free tier limits.

We do not offer prorated refunds for partial billing periods or mid-cycle downgrades. If you believe you were charged in error, contact us at support@runuppro.com and we will review your case promptly.

The Sales Portal add-on is a one-time purchase per aircraft and is non-refundable once activated.

6. Your Content

You retain full ownership of all content you upload to Runup, including logbook scans, maintenance records, aircraft documents, and any associated data. We do not claim any ownership rights over your content.

By uploading content, you grant Runup a limited license to process, store, and display your content solely to provide the Service. This includes running OCR and AI processing to extract and organize maintenance entries from your scans.

You are responsible for ensuring you have the right to upload any content you submit. Do not upload content that infringes on the rights of others.

7. AI Processing

Runup uses AI and machine learning services to extract text from scanned logbook pages and organize maintenance entries. AI processing is not perfect. Extracted entries may contain errors. You are responsible for reviewing all extracted content before accepting it as part of your digital record.

AI-generated extractions are provided as a convenience and should not be relied upon as the sole source of truth for maintenance records. Always verify against your original paper logbooks.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations.
• Attempt to gain unauthorized access to the Service or its underlying systems.
• Upload malicious content, including viruses, malware, or files designed to disrupt the Service.
• Resell, redistribute, or sublicense access to the Service without our written permission.
• Use automated tools to scrape, crawl, or extract data from the Service beyond normal use.

9. Intellectual Property

The Runup platform, including its design, code, features, and branding, is owned by Runup and protected by applicable intellectual property laws. These terms do not grant you any rights to our trademarks, logos, or other brand elements.

10. Disclaimers

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service. Specifically:

• We do not guarantee that OCR extractions will be error-free.
• We do not guarantee uninterrupted access to the Service.
• We are not responsible for regulatory compliance decisions made based on information displayed in the Service. Always verify against official FAA records and your original logbooks.

11. Limitation of Liability

To the maximum extent permitted by law, Runup and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these terms or engage in conduct that is harmful to other users or the Service. You may delete your account at any time by contacting us at support@runuppro.com.

Upon termination, your right to use the Service ceases. We may retain certain data as required by law or for legitimate business purposes, but will delete your personal data upon request in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice within the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.
